Notice: Patent #7,032,586 titled
"Single Point Engraving Cutter Tip" is scheduled for issue
at the US
patent and trademark office April 25, 2006. If you're interested
in licensing it for use you may do so at this time or you may wait
until the issue date. If you choose now, the license
agreement will not go into effect until the issue date of the patent.
The
Lindsay Point Geometry is free to use for anyone that accepts the
terms of the agreement.
Patent License
The Patent License ("License" or "Agreement") governs the use of the
Lindsay Point Geometry and Process defined by U.S. Patent No. 7,032,586. Anyone can license the use of the patented
Lindsay Point Geometry (as
defined below) by agreeing to be bound by the terms of this License. Such person is considered to be the Licensee ("Licensee"). As long as
the Licensee complies with the terms and conditions of this License, the
Licensee may continue to use the patented Point Geometry and Process for his or her engraving work.
Definitions
1. "Lindsay Point™" and "Lindsay Point Geometry" means the graver
point geometry and process covered by U.S.
Patent No. 7,032,586 issued April 25, 2006 and entitled "Single Point
Engraving Cutter Tip".
2. "License" means this License in its entirety, also known as the
Lindsay Point Geometry License.
3. "Licensor" means Steven J. Lindsay, the inventor and owner of U.S.
Patent No. 7,032,586.
4. "You" means any person that makes use of the Lindsay
Point™ and agrees to be bound by provisions of this License ("Licensee").
5. "AirGraver™" means Lindsay AirGraver pneumatic handpieces as defined
in U.S. Patents: 6,095,256, 6,691,798, 6,530,435, 6,508,315, 6,488,102,
and 6,691,798.

Approved Use
In addition to the other terms and conditions of this License, use of
the Lindsay Point Geometry is permitted, without fee or royalty, when used:
1. For hand engraving; This may include bright cutting, western style
engraving, banknote engraving, bulino engraving, jewelry engraving, bright-cut
stone setting engraving,
Intaglio
engraving, print engraving, Heraldic engraving or other hand engraving
styles.
2.
By individuals in
commercial, personal
and private use, using power-assisted hand engraving tools, hammer and
chisel engraving, palm-push and PalmControl AirGraver™
hand engraving.

Restrictions and
Requirements
1. Discussions, drawings, helping and teaching one another concerning
the angles used or preferred for the Lindsay Point™ on internet
forums are welcome and encouraged as long as the forum is not sponsored
by an unauthorized engraving tool manufacturer, engraving school or
employee or person of such an entity and it is made
clear that the Point Geometry is patented
and that this royalty free License is required for its use.
2. The Lindsay Point Geometry may be referred to in text on internet web pages of engravers that use the
Point Geometry and have
agreed to the terms of this license as long as it is made clear that it is patented and a link to this License or a link to the
information about it at
www.EngravingSchool.com/private/LindsayGrind.htm
is provided.
3. The Lindsay Point
Geometry is to be called by a name that defines the geometry, grind or
point as being patented; for example "Lindsay Point".

Un-Approved Use
1. The Lindsay Point™ may not be taught in facilities, schools, public
or private classes, or on-line internet engraving courses without entering into a separate license agreement
that may include royalties. If an individual or school is
interested in becoming an authorized (certified) facility for teaching
the Lindsay Point™, please visit
www.EngravingSchool.com/schools.htm.
2. The Lindsay Point™ may not be pictured, taught or
illustrated in printed flyers, instructional videos, electronic media
videos, or printed publications without written permission or entering into a separate license
agreement that may include royalties. If
there is any question or desire to use the Point Geometry for a special case,
please feel free to ask.
3. Selling, instructing or teaching the Lindsay Point Geometry for
corporate or personal profit or
gain by any means is prohibited.

Obligations
1. This Agreement is the entire agreement between the parties with
respect to this subject matter.
2. This Agreement shall be governed by the laws of the State of
Nebraska, without giving effect to principles of conflicts of law. In
addition, any action or proceeding arising from or relating to this
Agreement, except for actions solely relating to issues regarding
compliance with or interpretation of the agreement must be brought in a
federal court in Nebraska. Each party irrevocably submits to the
jurisdiction of venue of any such court.
3. All notices, requests, demands, and other communications shall be in
writing and sent by electronic mail, nationally recognized overnight
carrier, or certified mail, postage prepaid, to:

Liability
Licensor shall have no liability for any direct, indirect,
incidental, special, exemplary, punitive, consequential, or other
damages. Licensor expressly disclaims any representations or warranties,
expressed or implied, regarding the product and use contemplated by this
Agreement, including, but not limited to, any implied warranty of
merchantability or fitness for a particular purpose. The Lindsay Point Geometry contemplated by this Agreement are provided
"as is" without warranty of any kind, either expressed or implied. The
entire risk as to the quality and performance of the products and
services contemplated by this Agreement are with the Licensee. Each
Licensee under this Agreement assumes all risks associated with its
exercise of rights under this Agreement, including but not limited to
the risks and costs of errors, compliance with applicable laws, damage
to or loss of any item, or equipment.

Termination and Limitations
1. This Agreement shall commence as of the date this Agreement is
executed and shall remain in full force and effect until
Three-Hundred-and-Sixty-Five (365) calendar days from the date of
execution subject to prior termination as provided below. Execution
shall be deemed complete as of the moment the Licensee accepts all terms
of this Agreement. Unless this Agreement is terminated as provided
below, this Agreement shall automatically renew for periods of
Three-Hundred-and-Sixty-Five (365) calendar days each until the
expiration of U.S. Patent 7,032,586.
2. The term of this License will be limited by compliance of the
Licensee. If conditions and terms of this License are not complied with, the License will be automatically terminated and all use of the
Lindsay Point Geometry must stop.
3. Licensee acknowledges that no other representations by Licensor exist
and that no other agreements exist between Licensee and Licensor. This
Agreement will be construed and interpreted according to the laws of the
State of Nebraska.
